Terms of Service

These Terms govern your use of animdept.com (the "Site") and any purchases

you make through it. The Site is operated by Sargeant Inc., a CT

corporation, doing business as "the animation dept" ("we", "us", "our").

By using the Site or purchasing a product, you agree to these Terms.

1. Products

The Site offers digital plugins and related software for third-party

applications. We are an independent developer and are not affiliated with,

endorsed by, or sponsored by any third-party application vendor. You are

responsible for obtaining and maintaining any third-party software

licenses required to use our products.

2. Orders and Payment

Purchases are processed by Lemon Squeezy (Lemon Squeezy Inc.), which acts

as the Merchant of Record for all transactions. Lemon Squeezy handles

payment, billing, sales tax, and refunds. Your purchase is also subject

to Lemon Squeezy's terms.

3. License

Each plugin is licensed, not sold, under our End User License Agreement

(the "EULA") at animdept.com/eula. By purchasing or installing a plugin,

you agree to the EULA.

4. Accounts

If the Site offers accounts, you are responsible for keeping your

credentials secure and for activity under your account.

5. Acceptable Use

You may not (a) resell, redistribute, or sublicense our products except

as expressly permitted; (b) reverse engineer, decompile, or attempt to

extract source code; (c) use the Site to violate any law or infringe

anyone's rights.

6. Intellectual Property

All content on the Site and in our products — including code, designs,

text, and branding — is owned by Sargeant Inc. or its licensors. No

rights are granted except those expressly stated in these Terms or the

EULA.

7. Disclaimer of Warranty

The Site and products are provided "as is" and "as available," without

warranties of any kind, express or implied, including merchantability,

fitness for a particular purpose, and non-infringement. We do not warrant

that the products will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, Sargeant Inc. will not be liable

for any indirect, incidental, consequential, special, or punitive damages,

or for lost profits or data, arising out of your use of the Site or

products. Our total liability for any claim will not exceed the amount

you paid us for the product giving rise to the claim in the 12 months

before the claim arose.

10. Changes

We may update these Terms at any time. Continued use of the Site after

changes are posted means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of [STATE], without

regard to its conflict-of-laws rules. Any dispute will be resolved in

the state or federal courts located in CT.
